Fiancé visas (K-1 visas) are notoriously difficult to get approved. Many people face denials. But the good news is: a denial is not the end of the road.

Can you apply for a spouse visa after a denied fiancé visa?

Yes! You are absolutely allowed to apply for a spouse visa (CR-1 or IR-1) after a fiancé visa denial. The government does not hold the prior denial against you as long as you are now applying under a different category.

How does it work?

The main challenge is logistical:

  • Since the fiancé visa allows marriage inside the U.S., if it’s denied, you now need to get married outside the U.S.
  • This usually means traveling to your fiancé’s country or finding a third country where you can legally get married.

Once married, you can begin the spouse visa process, which generally has higher approval rates and is often seen as a stronger, more permanent commitment.

Can you marry in a third country?
